This license applies to both the distributable and non-distributable portions of BACKUP-BURNER ADD-ON SDK as indicated below.  Your use of this software indicates your acceptance of this license agreement and warranty.  This is only a license to use the software, and does not under any circumstances convey ownership to the licensee.

  10. - "Unregistered" software developers are granted a non-exclusive, non-transferable license to try the BACKUP-BURNER ADD-ON SDK for a period of 45 days.  During this period of 45 days the software developer can use the BACKUP-BURNER ADD-ON SDK and distribute the BACKUP-BURNER LIBRARY file (BackupBurner.dll) for personal testing, in-house and public beta testing.  Use in any released products, including open source, freeware, demoware, shareware and commercialware is strictly prohibited by this license.

  12. - "Registered" software developers are granted a non-exclusive, non-transferable license to use the BACKUP-BURNER ADD-ON files and distribute only those files necessary for deployment, for a period of 1 year.  This license allows the BACKUP-BURNER LIBRARY file to be distributed only in conjunction with 1 software title, although variants such as "standard" and "professional" are considered 1 title.  Additional titles require additional licenses.  If the license is not renewed at 1 year the software developer agrees to remove the title containing the BACKUP-BURNER LIBRARY file from ALL distribution channels, including as a download on the Internet.

  14. The BACKUP-BURNER LIBRARY file (BackupBurner.dll) can be redistributed under the terms of a full ("Registered" software developers).  It includes the following embedded files: BackupBurner.exe, MI.EXE, mnb2k.nb, nborig.nb, and CdRwLib.dll.  No files can be used individually.

  16. This license can be terminated by DBMI for non-compliance of its terms.

  18. AutoRun.exe and Autorun.inf are covered by the AutoMenu freeware license.

The BACKUP-BURNER ADD-ON SDK contains, among other things, a portion of Desernet Broadband Media Recording Software, including copyrighted software, proprietary notices, and identifying information.  No one may alter, decompile, remove files, add files, replace files, rename files, or modify the Recording software.

This product is not intended for the illegal distribution of copyrighted materials or software.  DBMI provides only the software tools used to create the distributable BACKUP-BURNER files.  You, the user of the Registered version of BACKUP-BURNER ADD-ON SDK software, provide the content of the CD this software makes.  DBMI cannot control or take any responsibility for the content or distribution of material provided by you.  You assume all liability for distribution of and suitability of content.

  24. This product uses Click-To-Disc! technology developed by DBMI.  The technology is patent pending, all rights reserved.

The BACKUP-BURNER ADD-ON SDK is not warranted to support all CD Recorders on the market.  However, from time to time support of additional models may be added by the release of newer BackupBurner.dll files to registered software developers.  The software is not warranted to support every combination of hardware and software.  The software is not warranted for the quality, accuracy, or life span of information recorded on CD or DVD, so it is recommended that independent verification of the recorded information be performed by the software developer's program.

THIS SOFTWARE AND THE ACCOMPANYING FILES AND CONTENT ARE SOLD OR DISTRIBUTED "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED.  BECAUSE OF THE VARIOUS HARDWARE AND SOFTWARE ENVIRONMENTS INTO WHICH THE BACKUP-BURNER ADD-ON FILES MAY BE PUT, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED.  THE USER MUST ASSUME THE ENTIRE RISK OF USING THE PROGRAM.  ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT.
